L&R Photography Terms of Service

1. Terms & Conditions [2018 L&R Photography].

1.2 Subject to the express provisions of this notice:

(a) I, Lydia Elaine Orozco, own and control all the material and other intellectual

property rights of L&R Photography and the images on my website(s); www.LandRPhotos.com

www.LandR-Photography.com & www.facebook.com/LandRPhoto

(b) All of the images and other intellectual property rights in L&R Photography and the

material on our website are reserved.

2. Terms of L&R Photography

2.1 You may:

(a) View Photos from the L&R Photography website in a web browser; Or Private Gallery

(b) Download pages from the L&R Photography website for caching in a web browser;

Subject to the other provisions of this notice.

2.2 Except as expressly permitted by the other provisions of this notice, you are advised to print

photos if you so wish, from high resolution downloads you have accessible to you from your

personal online gallery. DOWNLOADS from website or social media may not come out as clear.

2.3 [You may only use the L&R Photography website(s) material for [your own personal use and

business purposes], and you must not use the L&R Photography website material for any other

purposes.]

2.4 Except as expressly permitted by this notice, you must not edit or otherwise modify any

material from L&R Photography. (Ex. No filters may be applied to published work on Instagram,

Facebook, or mobile applications)

2.5 Unless you own or control the relevant rights in the material, you must not:

(a) Republish material from/by L&R Photography claiming to be your own material

(including republication on another website, magazine, newspaper, museum, or any

business, fair, or convention involving the arts);

(b) Sell, rent or sub-license material from/by L&R Photography;

(d) Exploit material from/by L&R Photography for a business damaging purpose; or

(e) Redistribute material from/by L&R Photography, save to the extent expressly

permitted by this notice.

3. Unacceptable use

3.1 You must not:

(a) Use L&R Photography’s photo material in any way or take any action that causes, or

may cause, damage to the Business or impairment of the performance, availability or

accessibility of the business and the photography services that it offers.

(b) Use L&R Photography’s photo material in any way that is unlawful, illegal, fraudulent

or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or

activity;

limitation editing, photo shopping, data extraction and photo correcting) on or in

relation to any L&R Photography material. All work is to remain in its original form,

altering images or photos in any way can and will be resulting in legal action.

4. Report abuse

4.1 If you learn of any unlawful material or activity on my L&R website, or any material or

activity that breaches this notice, please let me, Lydia Orozco, know.

5. Enforcement of Published works

5.1 Lydia Orozco [L&R Photography] takes the protection of published works very seriously.

5.2 In the event that Lydia Elaine Orozco [L&R Photography] discovers that published works

have been abused in any way, Lydia Elaine Orozco may bring legal proceedings against you,

seeking monetary damages and/or an injunction to stop you using those materials in a harmful

manner. You could also be ordered to pay legal costs. Using L&R Photography material in any

way, shape, or form that she believes can be damaging to her business, will be subject to legal

consequences.

6. Permissions

6.1 You may request permission to use the published materials on L&R Photography website, or

photos provided to you by L&R Photography by signing a disclosure agreement provided by L&R

Photography, stating that you have permission to display the work on the internet, including

social networks i.e. Facebook, Twitter, Instagram, Pinterest, etc. (i.e. Photography Print

Release)

6.2 If you share Published work on your own personal social networks (i.e. Facebook,

Instagram, Pinterest, Twitter) you must reference L&R Photography, through linking

www.LandR-Photography.com tagging the L&R Photography facebook business page

(www.facebook.com/LandRPhotos ) or through Instagram username: @l_and_r_photography

6.3 All Work that is shared through personal social networks or online/the internet must be

Published work that is watermarked with the “L&R Photography” Brand. If Finals provided do

not have a Watermark, reference to business will suffice.

7. Payment Agreement

7.1 Full Payment for Photography Services is due at the time of service. No Exceptions.

7.2 L&R Photography does charge a TX tax rate of 8.25% on all sales & Services.

7.3 Cash and Credit/Debit Card Payments are the only forms of payment that will be accepted,

Checks or Money orders are not accepted.

7.4 If the client(s) choose to use card form of payment it is to their understanding that a 3%

Service Charge fee will be added to their Cost.

7.5 Client(s) must understand that no refunds are issued by L&R Photography. All sales are final

due to the work being done at the time of Service. When choosing L&R Photography for your

photography needs, you are in agreement that our work is in your best interest for selecting

Lydia Elaine Orozco as your preferred photographer.

8. Published Work [FINALS]

8.1 Client(s) must understand that all published work (photo finals) that is provided to them,

are the only finals that they will receive. We are not obligated or liable to deliver every image

taken at Photo Session.

8.2 Client(s) do not have the authority to request changes made to their published photos, any

particular suggestion that is wanting to be made by the client, must be established at the time

of service with L&R Photography. The final post production and editing styles, effects, and

overall look of the images are left to the discretion of Lydia Orozco of L&R Photography No

Exceptions. L&R Photography is under NO OBLIGATION to give you additional sessions, images,

re-shoots, do-overs, etc.

9. Limit of Liability

9.1 In the unlikely event that the photographer, Lydia Elaine Orozco, from the L&R Photography

is unable to perform photography services on date of appointment due to an injury, illness, act

of God, act of terrorism, or other cause beyond the control of the L&R Photography, L&R

Photography will make every effort to secure a replacement date for appointment(s). If the

situation should occur and a suitable replacement date is not found, responsibility and liability

is limited to the return of all payments received for the Service date if all monies are paid ahead

of time, but Deposits will not be refunded.

9.2 L&R Photography is limited by the rules and guidelines of the location(s) and site

management. The CLIENT(S) agrees to accept the technical results of their imposition on the

COMPANY. Negotiation with the officials for moderation of guidelines is the CLIENT's

responsibility; the COMPANY will offer technical recommendations only.

9.3 The CLIENT(S) is responsible for acquiring all permits and necessary permission for all

locations on which L&R Photography will be performing services.

9.4 L&R Photography reserves to right to terminate coverage and leave the location of the

Photography Service location if the photographer(s) from the L&R Photography experiences

inappropriate, threatening, hostile or offensive behavior from person(s) at the time of service;

or in the event that the safety of the photographer from L&R Photography is in question.

9.5 If client’s chosen location requires payment for parking, it is the client’s responsibility to pay

the parking fee of the photographer. Parking fees can and will be added to the client’s overall

total that is due at the session.

9.6 L&R Photography is not responsible for compromised coverage due to causes beyond the

control of L&R Photography including but not limited to obtrusive behavior, lateness of the

CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to

L&R Photography, rendering of decorations (props), or restrictions of the locations. L&R

Photography is not responsible for backgrounds or lighting conditions which may negatively

impact or restrict the photo coverage. L&R Photography is not held liable for missed coverage

of any part the EVENT(S). L&R Photography will not be held accountable for failure to deliver

images of any individuals or any objects at the EVENT(S).

10. Pricing

10.1 Client(s) are in agreement with the pricing of L&R Photography Services. Prices are set and

are non-negotiable.

10.2 Client(s) must pay a deposit to L&R Photography in order to schedule, Book, or Reserve

their appointment date. All Deposits made are non-refundable. Deposit does count toward

total cost owed to L&R Photography for scheduled Photography Services, and remaining

balance is due at time of session.

10.3 Client(s) who choose to pay L&R Photography in cash must have exact amount owed at

time of service, L&R Photography does not provide change.

10.4 L&R Photography does charge a TX tax rate of 8.25% on all sales & Services.

11. Scheduling

11.1 Client(s) must confirm appointments at least 24 Hours in Advance with L&R Photography,

if Appointments need to be rescheduled & the client(s) are unable to attend their scheduled

photo session with L&R Photography, L&R Photography must be contacted at least 72 hours

before the scheduled date and time to change the date of service. This will keep the deposit

active for all Client(s)

11.2 If Client(s) fail to confirm appointments before their appointment date, L&R Photography

is entitled to cancelling the appointment. Deposit will not remain active for Client(s)

appointment, nor be refunded to the client by L&R Photography.

L&R Photography-Client Contract Agreement

As a client of L&R Photography, I have read and understand the L&R Photography Photographer-Client Agreement

& Contract, I agree to abide by all terms listed in the contract agreement. If I fail

to abide to any of the terms listed, it is to my understanding that I can be facing

legal action resulting in paying legal costs/fees. All work provided to me from L&R

Photography is rightfully owned by the brand and is of Lydia Orozco’s ownership

for use of advertising & marketing. It is to my understanding that L&R

Photography owns the right to publish any photographs that were taken of me,

and/or any persons I am paying services for, on any form of paper publication, as

well as viral/Virtual publications; including all social networks. I am agreeing that

any images that I post on social networking is not to be credited to anyone other

than Lydia Orozco DBA L&R Photography. It is also to my understanding that L&R

Photography’s style has been of my choosing, and all monies paid to L&R

Photography for photo services are non-refundable, and in no way, whatsoever,

are “re-shoots” or additional photos, [other than ones delivered to me], obligated [Owed] to me.

With paying my Deposit to Lydia Orozco DBA L&R Photography, I am agreeing to all terms and conditions listed in the contract.
